Atmospheric emissions draft regulations released | Infrastructure news

Draft regulations for national atmospheric emissions reporting have been published for comment.

The purpose of these Regulations is to regulate reporting of data and information from an identified point non-point and mobile sources of atmospheric emissions to an internet-based National Atmospheric Emissions Inventory System (NAEIS) towards the compilation of atmospheric emission inventories.

The draft regulations have implications for the transparency of emissions reporting and are also linked to the developing legal regime applicable to the proposed carbon tax.

The draft regulations state that any person classified as a data provider must register on the NAEIS within a period of 30 days from the date upon which the regulations come into effect.

Any person who fails to comply with the regulations is subject to a maximum fine of R5 million or 5 years imprisonment in the case of a first conviction to. In the case of a second or subsequent conviction, offenders will be subject to a maximum fine not of R10 million or 10 years imprisonment.
